CNN —Attorneys for Donald Trump want to delay the start of his upcoming New York criminal trial until the US Supreme Court weighs in on presidential immunity, according to a new motion – a ruling that may not come until late June. But Trump wants to wait until after the Supreme Court rules on immunity. Trump’s lawyers also requested that Merchan hold an evidentiary hearing after the US Supreme Court rules on the presidential immunity issue to then determine what evidence of Trump’s “official acts” should be precluded based on presidential immunity. “While the concept of presidential immunity is firmly established, the doctrine’s scope presents a ‘serious and unsettled question of law.’ Therefore, the Court should adjourn the trial until the Supreme Court resolves Trump v. United States for several reasons,” Trump’s motion says. “Waiting to try the case until after the Supreme Court addresses the question before it – following oral argument just next month – will likely simplify the application of the defense to evidentiary issues raised by the People’s motions in limine.”

Washington CNN —Former President Donald Trump has appealed an Illinois judge’s decision that disqualified him from the state’s upcoming Republican primary ballot. The surprise court ruling this week throws into question whether votes cast for Trump will be counted. Porter issued her decision Wednesday night and paused the decision for two days, so Trump could appeal. Trump’s lawyers asked her on Thursday to extend the pause until all of their potential appeals are exhausted in Illinois courts. CNN —Former President Donald Trump asked a New York appeals court on Wednesday to delay his obligation to post $454 million until his appeal of the civil fraud verdict is over. “The judgment order unprecedented and punitive disgorgement of nearly $460 million and overbroad permanent injunctive relief against Appellants in the absence of legal authority or factual support,” Trump’s attorneys wrote in the filing. Trump has less than 30 days to post the money to prevent the New York attorney general’s office from taking steps to execute the judgment, including potentially move to seize properties. CNN —Donald Trump’s attorneys are joining calls for the dismissal of Fulton County District Attorney Fani Willis in the 2020 election subversion case against the former president and his co-defendants in Georgia, pointing to alleged misconduct between Willis and her lead prosecutor. The filing also points to public comments Willis recently made defending her choice to select the lead prosecutor, Nathan Wade, arguing that she violated Georgia rules for prosecutors. In comments Willis made at Atlanta’s Big Bethel A.M.E. Church earlier this month, the DA defended her team of prosecutors in the case, calling into question why only one of the three prosecutors was being attacked. The district attorney’s office declined to comment on the latest filing. Trump’s attorneys claim that Willis made a “calculated effort to foment racial bias” against the defendants with her comments, which run the risk of prejudicing the public and prospective jurors.

Defeated DeSantis Bows to Trump in GOP Primary

Ron DeSantis was the conservative policy wunderkind considered the GOP's solution for reuniting the Republican Party in a post-Trump world. The announcement came just two days before the Republican presidential primary in New Hampshire , with DeSantis polling in the single digits in the Granite State. Yet, like all of Trump’s other presidential primary challengers, DeSantis had difficulty escaping Trump’s penumbra and failed to dent the support of his MAGA movement. He consistently polled some 40% to 50% behind Trump among likely Republican primary voters, despite his campaign and supporting political action committees raising more than $100 million to break through. Indeed, DeSantis placed a distant second in the Iowa caucuses on Jan. 15, nabbing just 21% of the votes compared with 51% for Trump.

CNN —Former President Donald Trump is urging the US Supreme Court to reverse the Colorado Supreme Court’s ruling that removed him from that state’s ballot. “The Court should reverse the Colorado decision because President Trump is not even subject to section 3, as the President is not an ‘officer of the United States’ under the Constitution. And even if President Trump were subject to section 3 he did not ‘engage in’ anything that qualifies as ‘insurrection,’” Trump’s attorneys argued. The US Supreme Court agreed earlier this month to hear the case, accepting an appeal brought by Trump. The Oregon Supreme Court dismissed a similar case last week, telling the anti-Trump challengers that they might be able to refile it later, based on what the US Supreme Court does in the Colorado case.
